PORAC, Pampanga — The Commission on Elections Region III has issued a show cause order against Porac councilorable Dexter David for alleged misinformation.
In his complaint lodged at the COMELEC, Mr. Relito L. Laxamana said David had been telling Porac residents that reelectionist Mayor Jing Capil had been disqualified in the mayoral race.
Laxamana said “there has been widespread misinformation, and we received multiple reports that campaigners of the opposing party were discouraging voters from voting for Mayor Jing (Capil).”
Laxamana said the “reckless statements of Dexter David constitute a violation of election laws” referring to Section 261 of the Omnibus Election Code which penalizes individuals “causing confusion among the voters, propagates false and alarming reports or information.”
Laxamana said the dismissal order of the Ombudsman issued on April 3, 2025, is not yet final and executory, and a Motion for Reconsideration is still pending in the court.
The Supreme Court has issued a Temporary Restraining Order enjoining the COMELEC from implementing COMELEC Resolution No. 11044-A dated September 4, 2024. The resolution sought to diaqualify candidates who had been dismissed from service due to administrative cases, regardless of whether such dismissal was final and executory.
COMELEC Regional Election Attorney Atty. Numerous P. Lobo has given David three days to reply on the said complaints.
