In a significant legal victory, the Regional Trial Court in Capas, Tarlac, issued a Temporary Restraining Order (TRO) on October 4, 2024, against the Bases Conversion Development Authority (BCDA) and Clark Development Corporation (CDC), halting their efforts to take over the Kalangitan Landfill. Metro Clark Waste Management Corporation (MCWMC) expressed disappointment over BCDA and CDC’s actions, noting that their lease for the 100-hectare site remains valid until 2049.
MCWMC emphasized that the court’s ruling protects both their operations and the communities that rely on the landfill, which serves as a crucial waste management facility for millions across Central and Northern Luzon. The company has operated the landfill for over 20 years, adhering to stringent environmental regulations under Republic Act 9003.
Closure of the landfill, MCWMC warned, would have dire consequences for local communities, depriving them of the only fully compliant waste disposal site in the region. The company reiterated its commitment to efficient waste management and expressed hope that all parties involved could collaborate to ensure public welfare and environmental protection. MCWMC remains resolute in pursuing legal avenues to safeguard its rights and continue its essential services.
